19-09-2017 Heard Sri Surendra Kumar Mishra, learned counsel for the petitioner and Sri Binod Kumar No. 3, learned Addl. Public Prosecutor.

The sole petitioner, who is in custody in Kargahar P.S. Case No. 124 of 2017 registered for offence under Section 30(a) & 35 of the Bihar Prohibition and Excise Act, 2016, has prayed for grant of bail.

It was submitted by learned counsel for the petitioner that nothing was recovered from conscious possession of the petitioner, however; in the case, recovery of Indian make foreign liquor was shown and petitioner is in custody since 14-05-2017.

Considering the nature of accusation and period of custody, let the petitioner namely Manoj Gupta be enlarged on

Patna High Court Cr.Misc. No.42197 of 2017(2) dt.19-09-2017 2/2 bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II -cum- Special Judge (Excise), Rohtas at Sasaram in connection with Kargahar P.S. Case No. 124 of 2017.
