Heard learned counsel for the petitioners and the State. The petitioners seek bail in in connection with Sessions Trial No. 5 of 2019 arising out of Khudaganj P.S. Case No. 113 of 2018, instituted for the offence under Section(s) 302/34 of Indian Penal Code.
It is alleged in the written report that younger brother of informant namely, Ranjit Kumar had love affair with daughter of Ramji Paswan. It is further alleged that younger brother of the informant had come to village during Dussehra festival. On 18.10.2018 at about 11:00 p.m. petitioners came to house of the
Patna High Court CR. MISC. No.16743 of 2019(4) dt.02-09-2019 2/2 informant and took his younger brother for seeing Mela and he did not return. Later on, his dead body was recovered from paddy field. Counsel for the petitioners submits that mere suspicion has been raised against petitioners in the written report. They have been made accused because they are uncle and brother of the boy Ranjit Kumar.
Petitioners are in custody since 21.10.2018 having clean antecedent.
Considering the aforesaid facts and circumstances of the case, prayer of the petitioners for grant of bail is allowed. Let the petitioners above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned A.D.J. II, Hilsa, Nalanda, in connection with Sessions Trial No. 5 of 2019 arising out of Khudaganj P.S. Case No. 113 of 2018, subject to the condition that both the bailors will be close relatives of the petitioners. S.Ali/- (Sanjay Priya, J) U T
