JUSTICE VINOD KUMAR SINHA ORAL ORDER 18-06-2019 This is an application for grant of anticipatory bail in connection with Sheikhpura P.S. Case No. 754 of 2018, disclosing offences under Sections 304(B), 34 of the Indian Penal Code.
Allegation against the petitioner who happens to be the husband of the deceased daughter of the informant. Submission of the learned counsel for the petitioner is that deceased was pressuring the petitioner to reside separately from his family members. He has falsely been implicated in this case, having two small kids. It has further submitted that the witnesses of the village has also not supported the prosecution case.
Heard learned A.P.P. as well as the learned counsel appearing on behalf of the informant also, who has opposed the
Patna High Court CR. MISC. No.16529 of 2019(4) dt.18-06-2019 2/2 prayer for bail on the ground that earlier informant has made complaint to the Mahila Commission and thereafter, the petitioner has brought the deceased 3-4 months ago and there is further demand of dowry also, as such, there is prima facie materials against the petitioner.
Having heard both sides, in view of the facts and circumstances, as stated above, I am not inclined to grant privilege of anticipatory bail to the petitioner, however, the petitioner is directed to surrender before the learned court below and make prayer for regular bail, which shall be considered on the basis of the materials available on record and if possible to be disposed of on the same day.
