JUSTICE AMARESH KUMAR LAL ORAL ORDER 20-01-2015 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner apprehends his arrest in a case registered for the offence punishable under Sections 323, 324, 307, 504, 379, 380, 452 of IPC.

Allegation against the petitioner is to have assaulted the informant with garasa.

It is submitted that complaint was lodged on 5.8.2013, whereas the occurrence is alleged to have taken place on 22.4.2013. On the basis of complaint, this police case has been lodged. The injury is simple in nature. The petitioner is the brother-in-law of the informant. There is land dispute between both the parties and there is also case and counter case. The police has also recommended for initiation of proceeding under Section 107 Cr.P.C. between both the parties. The petitioner has

Considering the facts and circumstances, in case of arrest or surrender within a period of four weeks the above named petitioner will be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nawada in Hisua P. S. Case No. 212 of 2013, subject to the condition as laid down under Section 438(2) of the Code of Criminal Procedure and the other following conditions:- (i) The petitioner will not indulge himself in similar or any other offence.

(ii) One of the bailors must be the close relative of the petitioner.

(iii) The petitioner will be well represented in the Court on each and every date and in case of absence for two consecutive dates or in case of violation of terms of bail, his bail bond would be liable to be cancelled by the learned Court concerned.
