Petitioner seeks bail in G.O. Case No.542 of 2019 (Keoti P.S. Case No.83 of 2019) registered under Sections 30(a), 38(i) and 41(i) of the Bihar Prohibition and Excise Act. The informant received information that Dev Narayan Yadav @ Chhotu Yadav was unloading wine from a truck. On such information, the police officials went there to verify the same. Seeing the police, the persons present there fled away. The police recovered huge quantity of liquor. Learned counsel for the petitioner submits that the petitioner is not named in the F.I.R. The name of the petitioner figured in the case in the confessional statement of Dev Narayan Yadav @ Chhotu Yadav. Nothing has been recovered from possession of the petitioner. Patna High Court CR. MISC. No.16426 of 2020(3) dt.03-06-2020 2/2 13.01.2020. Co-accused Dev Narayan Yadav @ Chhotu Yadav and Hiralal Yadav have already been granted bail. Having considered the facts that the name of the petitioner figured in the case in the confessional statement of coaccused Dev Narayan Yadav @ Chhotu Yadav and nothing has been recovered from possession of the petitioner and the fact that co-accused Dev Narayan Yadav @ Chhotu Yadav and Hiralal Yadav have already been granted bail and the petitioner is in custody since 13.01.2020, the petitioner named above is directed to be released on bail on furnishing bail bond of Rs.10,000/-(rupees ten thousand) with two sureties of like amount each to the satisfaction of learned 2nd Additional Sessions Judge-cum-Special Judge (Excise Act), Darbhanga in connection with G.O. Case No.542 of 2019 (Keoti P.S. Case No.83 of 2019).
