2. The petitioners apprehend their arrest in a case registered for the offence under Sections 126(2), 115(2), 118(1), 303(2), 76, 352, 351(2), 3(5) of the Bhartiya Nyaya Sanhita.
3. As per the prosecution case, on 06.12.2024 at about 6:30 AM, all the F.I.R. named accused persons including these petitioners came at the door of informant and started abusing him and on protest, co-accused Anish Kumar Mishra assaulted on the head of informant with Dabiya and co-accused Avinash
Patna High Court CR. MISC. No.17198 of 2025(2) dt.08-04-2025 2/3 Mishra assaulted with knife to informant, whereas, petitioner no. 1 (Sanjay Mishra) assaulted informant by butt of pistol. It is further alleged that when wife and son of informant came to rescue, they were also assaulted. It is also alleged that petitioner no. 1 & 3 disrobed the wife of informant. Besides this, accused persons also broke the lock of the box, kept inside house, and looted jewelery, cash and some household articles.
4. Learned counsel for the petitioners submits that both parties are Gotiyas and due to existing land dispute, quarrel took place between them. As per injury report, the injuries, sustained by informant, are simple in nature. Rest of the allegation is ornamental. Petitioners claim clean antecedent.
5. Learned A.P.P. for the State has opposed the bail petition.
6. Considering the aforesaid facts and circumstances, let the above named petitioners, in the event of their arrest/surrender within a period of eight weeks from today, be enlarged on bail on furnishing bail-bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned A.C.J.M. - VI, Sitamarhi / concerned Court in connection with Riga P.S. Case No. 428 of 2024, subject to condition as laid down under Section 482 of the
