2. The petitioner is in judicial custody in connection with Bodhgaya P.S. Case No. 472 of 2023 for the offence punishable under Section 376(2)(iii),(i) of the Indian Penal Code and section 4/6 of POCSO Act lodged on 02.06.2023 by the informant, Guriya Devi.

3. As per the prosecution story, the informant alleged that she had gone to the market for purchasing, leaving her 13 years old daughter (victim girl as also seven years old son) when this petitioner entered the room and raped the minor child. Accordingly, the FIR.

4. A coordinate bench had called for the case diary and the 164 Cr.P.C. statement and the victim girl (13 years) narrated her ordeal, according to which after pushing her minor

Patna High Court CR. MISC. No.21902 of 2024(7) dt.24-10-2024 2/2 brother outside the room, the petitioner closed the room and raped her.

5. Considering the allegation that has come against the petitioner, no case of bail is made out and the petition accordingly stands rejected.
