The petitioner, already in custody, seeks bail in connection with Bidupur P.S.Case No. 124 of 2018 registered under Sections 379 and 414 of the Indian penal Code and Section 25(1)a/26 of the Arms Act.

Allegation in brief is that stolen mobile was found in possession of the Petitioner and using the SIM Card issued in his name.

Submission is that there is no recovery from the possession of the petitioner.

Whereas, learned counsel for the State submits that seizure list clearly indicates he was found in possession of stolen mobile using the SIM issued in his name. Having considered the aforesaid facts and circumstances,

Patna High Court Cr.Misc. No.40479 of 2018(4) dt.17-07-2018 2/2 presently, the prayer of bail of the petitioner is rejected, however, he may renew prayer of bail after framing of the charge.
