The petitioner apprehends his arrest in connection with Hasanpur P.S. Case No. 203 of 2017 registered under Sections 341, 323, 324, 307, 504, 506/34 of the Indian Penal Code and section 27 of the Arms Act.
Learned counsel appearing on behalf of the petitioner submits that petitioner is innocent and has falsely been implicated in the present case. There is admitted land dispute between the parties. Further submission is that on perusal of Annexures-2 and 3 to the bail application, it appears that the petitioner was not present at the time of alleged occurrence. She was at her Naihar where she was admitted at Hospital for giving birth to a male child. The Investigating
Patna High Court CR. MISC. No.16130 of 2019(4) dt.20-06-2019 2/2 Officer verified it from the Doctor and villagers. The victims were treated at the private nursing home and the injury report was also prepared by the Doctor at Anneuxre-4. Further submission is that in course of investigation, in paragraph no.19 of the case diary, it appears that the petitioner is not involved in the present case.
Having considered the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the A.C.J.M.-III, Rosera in connection with Hasanpur P.S. Case No. 203 of 2017, subject to the condition as laid down under Section 438(2) of the Cr. P.C. (Arvind Srivastava, J) shailendra/- U T
