2. Petitioner apprehends arrest in a case registered for the offences punishable under Sections 419, 420, 467, 468, 471/34 of the Indian Penal Code.
3. Allegation is that this petitioner along with other F.I.R. named accused persons withdrew excess amount of money from their savings account through the ATM.
4. It is submitted on behalf of the petitioner that the alleged amount of defalcation has already been refunded in the bank by the petitioner. Petitioner claims clean antecedent.
5. Learned counsel for the Bank of India does not dispute the contention made on behalf of the petitioner.

Considering the contention made on behalf of the petitioner, this anticipatory bail is allowed and it is ordered that let the above named petitioner in the event of his arrest/surrender before the court below within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Saharsa in connection with Saharsa Sadar P. S. Case No. 1247 of 2017, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
