The short issue raised by the petitioner's counsel is that he had worked as Incharge, Excise Superintendent in between 15.04.2008 till 31.08.2009 when he retired as such. He submits that he has made a claim for being allowed the benefits of the said higher post for which he has discharged duties till his retirement. The claim of the petitioner (Anneuxre 8) is said to be pending before respondent No 3.
Since the issue is to be determined by respondent No 3, this Court is not called upon to adjudicate the issue. Interest
Patna High Court CWJC No.9462 of 2015(2) dt.13-11-2019 2/2 of justice would be served by directing respondent No 3 to dispose of the petitioner's claim in accordance with law by reasoned and speaking order, within a period of three months from the date of receipt/production of a copy of this order.
