The petitioners have preferred this application for grant of regular bail in a case registered under sections 379, 302 and 201 of the Indian Penal Code As per the prosecution case, it is stated by the informant that his son who used to drive the tempo owned by one Sohan Sah was informed by the said Sohan Sah that his son did not return with the tempo. Subsequently, his dead body was discovered.

It is submitted by learned counsel for the petitioners that the FIR was registered against unknown. The name of the petitioners transpired in course of investigation in the

Patna High Court CR. MISC. No.26531 of 2021(3) dt.16-12-2021 2/2 confessional statement of co-accused Santosh Kumar made before police which is inadmissible. The petitioners are in custody since 10.10.2020 and have no criminal antecedent. Charge sheet has been submitted in the case.

Having heard learned counsel for the parties and taking into consideration the facts of the case, the material that has transpired in course of investigation, the petitioners being in custody for more than 1 year and not having any criminal antecedent, the Court directs the petitioners to be enlarged on bail in connection with Deepnagar P.S. Case no. 308 of 2020 on each of them furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Nalanda at Biharsharif.
