The petitioner seeks regular bail in S.Tr.No.104/17 arising out of Ara Town P.S. Case No.244 of 1994 registered for the offence under Section 302/34, 324, 307 of the I.P.C. and 27 of the Arms Act.

Allegation against the petitioner is of general and omnibus and he was absconding since 1994 and his prayer for bail was rejected with observation "at this stage" vide Annexure-1 to this petition.

Submission of the learned counsel for the petitioner is that now commitment of this case has already been made and charge has been framed on 12.06.2017 and nine witnesses have been examined so far and he is in custody for ten months.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.25,000/- with two sureties of the like amount each to the satisfaction of 6th Additional Sessions Judge, Bhojpur at Ara, in S.Tr.No.104/17 arising out of AraAra Town P.S. Case No.244 of 1994 subject to the conditions that (1) one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned court. (2) The petitioner will not induce any witness or tamper with the evidence. (3) The petitioner shall co-operate in disposal of trial and make himself available as and when required by the court. In the event of failure on his part to appear before the court below on two consecutive dates without showing any genuine reason, his bail bond shall be cancelled.
