The petitioners seek bail in connection with Tekari P. S. Case No. 360 of 2017 registered under Section 302/34 of the Indian Penal Code.

Learned counsel for the petitioners submitted that the names of the petitioners were given in the FIR only on suspicion on the ground of enmity existing from before. Apart from wild suspicion and hypothetical presumption, there is no other material to connect the petitioners with the offence alleged.

Learned counsel for the State submitted that the

No.15888 of 2019(3) dt.20-05-2019 2/3 enmity between the parties is admitted and it was because of the previous enmity the petitioners committed murder of father of the informant. However, he admitted that except circumstantial evidence and suspicion, there is no other material in the casediary against the petitioners. Considering that save and except suspicion, there is no other material, the petitioners are directed to be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand only) with sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gaya in connection with Tekari P. S. Case No.
