The petitioner seeks bail in connection with Khagaria (Gangour) P.S. Case No.658 of 2023 registered for the offence punishable under sections 307, 353/34 of the Indian Penal Code and under sections 25(1-b) a, 26 and 35 of the Arms Act.

On secret information, the police came near Gahtara Bandh. Upon seeing the police party, five persons managed to flee away but one person was apprehended by the police. Upon search, five live cartridges were recovered from the apprehended person.

The petitioner was not caught on the spot. He has been named in the confessional statement of the person,

Patna High Court CR. MISC. No.18204 of 2024(2) dt.14-03-2024 2/2 who was caught on the spot. The petitioner is in custody since 24.11.2023.

Considering the aforesaid facts, this application is allowed.

Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Khagaria, in connection with Khagaria (Gangour) P.S. Case No.658 of 2023. 7.

This is also subject to the condition that the petitioner shall mark his presence in Gangour (Khagaria) Police Station, District- Khagaria on first Sunday of every month. Any default in appearance at the Police Station would result in cancellation of bail bonds of the petitioner. (Sandeep Kumar, J) pawan/- U T
