Petitioners seek bail in a case registered for the offences punishable under Sections 147, 149, 341, 323, 337, 338, 307, 427, 504, 302 of the Indian Penal Code and Section 27 of the Arms Act.
Allegation as per FIR is that one Md. Akbar Ali dashed with vehicle causing injury to one Reja @ Sufi and when informant was taking the injured for treatment, the petitioners and others have assaulted the informant by lathi and rod causing injuries and later on Reja @ Sufi succumbed to the injuries. Submission of learned counsel for the petitioners is that the main allegation is against Akbar Ali and case has been
Patna High Court Cr.Misc. No.38770 of 2018 (3) dt.12-07-2018 2/2 filed by the petitioners' side also against the informant alleging that they have also received injuries and a number of cases are going on between the parties.
Considering the aforesaid facts, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs.20,000/- (Rupees Twenty Thousand) each with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Madhubani Town Police Station Case No. 349 of 2014, subject to the condition that the petitioners shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioners as well as condition that both the bailors shall be resident of within the territorial jurisdiction of the learned court below.
