The petitioner seeks bail in a case registered for offences under Sections 8, 20, 22 of the NDPS Act and Sections 47(a), 47(g), 49, 50(d), 51 and 49(a) of the Bihar Prohibition and Excise Act, 2016.

It is contended that as per allegation, 2.5 Kgs. of ganja and 4.80 litres of country-made liquor were allegedly recovered from the house of Kanhaiya Yadav on his confession the petitioner has been implicated in this case, however, he is made accused in another case, i.e., Jadopur P.S. Case No. 36 of 2016 for offences under Sections 272, 273 and 420 of the Indian

Patna High Court Cr.Misc. No.40425 of 2017(2) dt.25-08-2017 2/2 Penal Code and Sections 147(g), 49, 50(d) and 59(a) of the Bihar Liquor Prohibition & Excise Act, 2016. It is further contended that the petitioner is in custody since 31.05.2017. Considering the facts and the circumstances of the case, the petitioner, above named is directed to be released on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the District & Sessions Judge-cum-Special Judge, NDPS Act, Gopalganj in connection with Jadopur P.S. Case No. 45 of 2016 with a condition that if the petitioner, after his release in this case, is again found to be involved in criminal case of similar nature, the court concerned would be at liberty to take steps for cancellation of his bail bonds.
