Let the defect(s), if any, be removed within a period of four weeks from today.

The petitioner seeks bail in connection with Dariyapur P.S. Case No. 36 of 2023 registered for the offence under Sections 30(a), 41(1) (2) of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that the petitioner is in custody since 25.01.2023 and there is a recovery of 336.9 liters of illicit liquor.

Learned A.P.P. has vehemently opposed the prayer for bail.

Considering the period of custody and the recovery

Patna High Court CR. MISC. No.16586 of 2023(2) dt.10-05-2023 2/2 of liquor, this application for regular bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District and Sessions Judge-II-Cum-1st Exclusive Special Judge, Excise, Saran at Chapra in connection with Dariyapur P.S. Case No. 36 of 2023.

The petitioner will visit concerned Police Station on the first Sunday of each month. Any default in appearance at the Police Station would result in cancellation of bail bond of the petitioner.
