JUSTICE VINOD KUMAR SINHA ORAL ORDER 18-10-2017 The petitioner seeks regular bail in connection with Galgalia P.S. Case No. 38 of 2017, registered for offences punishable under Sections 379, 411, 413 and 34 of Indian Penal Code.
Petitioner is said to be a driver and allegation is of committing theft by cutting 15 bundles of about 1000 metres of high tension wire.
It has been submitted on behalf of the petitioner that he has falsely been implicated in this case and nothing has been recovered from his vehicle and there is no eye witness that the petitioner was involved in committing theft of said wire. Further he is in custody since 13.06.2017.
Learned counsel for the State opposed the prayer for bail.

No.46039 of 2017 (3) dt.18-10-2017 Having heard both sides, considering the fact and circumstances of the case and also the fact that there is recovery of huge quantity of high tension of wire, I am not inclined to release the petitioner on bail, his application for regular bail is, accordingly, dismissed.
However, the trial court is directed to expedite the trial and try to conclude it within a period of six months and if the trial is not concluded within the aforesaid period, the trial court shall release the petitioner on bail to his own satisfaction. (Vinod Kumar Sinha, J) sunil/- U T
