The petitioner, already in custody, seeks bail in connection with Raushanganj P.S. Case No. 09 of 2018 registered under Sections 25 (1-b)a/26, 35 of Arms Act of the Indian Penal Code.

Learned Counsel for the petitioner submits that one country made loaded pistol was alleged to have been recovered from his possession but recovery of arm is fabricated. However, suffering in custody since last six months and had one criminal antecedent, in that case he was acquitted.

Having considered the aforesaid facts and circumstances, the petitioner, namely Md. Haider Ali @ Haider Ali is directed to be released on bail upon furnishing bail bond

Patna High Court Cr.Misc. No.33419 of 2018(3) dt.18-06-2018 2/2 of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Sherghati, in connection with Raushanganj P.S. Case No. 09 of 2018.
