Patna High Court Cr.Misc. No.17527 of 2015 (3) dt.19-05-2015 2/3 19-05-2015 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 147, 148, 149, 341, 342, 337, 307, 325, 427, 379 and 447 of the Indian Penal Code and Section 27 of the Arms Act.
It is alleged that the FIR named accused persons along with other unknown while returning from the orchestra program started destroying furniture and other articles of the informant's village when two miscreants were apprehended and handed over to police and subsequently the accused persons came and assaulted one Amarjeet, snatched bicycle, watch and mobile. The accused persons also pelted stones. In the meantime, the police force came and saved Amarjeet.
It is submitted by learned counsel for the petitioners that the accusation is omnibus and general against the mob. The injury report of Amarjeet reflects only two injuries, one of them has been found to be grievous. There is counter version of the occurrence also.
Considering the accusation against the mob, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of
