The petitioners apprehend their arrest in connection with Hulusganj P.S. Case No. 37 of 2015 registered for the offences punishable under Sections 379, 411 and 120(B) of the Indian Penal Code and Section 4 (1) and Section 40 of the Bihar Micro Mineral Concession Act, 1972 and Sections 1, 2 and 3 of the Bihar Illegal Mining Storage Transportation Act, 2003.

Learned counsel for the petitioner submits that petitioner is the owner of the red colour tractor which was seized. It is further submitted that petitioner lends the same tractor on hire to the contractor and he has no further connection in the act of loading and unloading of sand on the concerned tractor. It is further submitted that the other tractor which was seized on the same point of time, its owner is also facing prosecution and he has been extended the privilege of anticipatory bail

Patna High Court Cr.Misc. No.26179 of 2015 (4) dt.21-09-2015 vide order dated 22.07.2015 passed in Cr. Misc. No. 27266 of 2015.

Considering the aforesaid facts and circumstances of the case, let the petitioner above named, in the event of his arrest or surrender before the Court below within a period of three weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Jehanbad in connection with Hulusganj P.S. Case No. 37 of 2015, subject to the conditions as laid down under Section 438 (2) of the Cr. P.C.
