JUSTICE RAKESH KUMAR ORAL ORDER 20-05-2016 Heard Sri Akhileshwar Kumar Sharma, learned counsel for the petitioner and learned Addl. Public Prosecutor. The sole petitioner, apprehending his arrest in connection with Sathi P.S. Case no.237/15 registered for the offence under Section 414/34 of the Indian Penal Code and Section 7 of the Essential Commodities Act, has prayed for grant of anticipatory bail.

It was submitted by learned counsel for the petitioner that the petitioner after purchasing diesel for agricultural purposes along with others was carrying the same on motorcycle. The police suddenly intercepted and arrested some of the motorcyclist.

Learned counsel for the petitioner emphatically

Patna High Court Cr.Misc. No.19729 of 2016 (2) dt.20-05-2016 2/2 stated that the diesel, which was recovered from the petitioner, had been purchased for the purpose of agriculture, not for any other purpose.

Be that as it may, keeping in view the nature of accusation, let the petitioner, namely Javed Alam, in the event of his arrest or surrender within a period of six weeks from today, be released on bail on furnishing bail bond of Rs.10,000/-( ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, West Champaran at Bettiah in connection with Sathi P.S. Case No.237/15, subject to conditions as laid down in Section 438(2) of the Code of Criminal Procedure.
