Petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 307, 323, 324, 341, 34 of the Indian Penal Code.

The prosecution case is that the accused persons including the petitioners came armed with lathi, danda, spear and farsa and started abusing but when protest was made by the informant then co-accused Pratap Chaudhary caused injury on the abdomen of the informant with spear and when family members of the informant came to rescue then they were also assaulted.

It is submitted by learned counsel for the petitioners that specific accusation is against Pratap

Patna High Court Cr.Misc. No.24476 of 2015 (2) dt.30-06-2015 2/2 Chaudhary and the injury of the informant's side has been found to be simple. There is counter version of the occurrence and the petitioners' side received grievous injuries. It is submitted by learned counsel for the informant that seven persons received injuries from the informant's side but he has not controverted this fact that injury has been found to be simple and there is counter version of the occurrence where the informant's side received grievous injuries.

Considering the aforesaid facts, let the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gopalganj in connection with Mirganj P.S. Case No. 80 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
