JUSTICE DINESH KUMAR SINGH ORAL ORDER 19-05-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a complaint case filed with accusation punishable under Sections 406, 420 and 471/34 of the Indian Penal Code wherein process has been directed to be issued after cognizance being taken. It is alleged that one Jogmaya Devi and Munsawati Devi donated 18 kathas and nine dhoors of land in favour of Shree 108 Radha Krishn Jee and 108 Laxmi Narayan Jee, subsequently, Surendra Narayan Singh @ Lala singh who claimed himself to be SEVAYAT transferred the said land in favour of the petitioner. It is submitted by learned counsel for the petitioner that the petitioner is a bona fide purchaser of the land in question and Title Suit No. 02 of 2011 is pending for the same dispute and the sale deed was executed in the year 1979 when the complaint was

Considering the delayed lodging of the case and the petitioner being the purchaser, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned J.M., 1st Class, Saharsa in connection with Complaint Case No. 1092 of 2013, subject to the conditions as laid down under Section 438(2) Cr.P.C.
