The sole petitioner apprehending his arrest in Barauli P.S. Case No. 03 of 2016 registered for the offence under section 447, 504 of the Indian Penal Code and Section 27 of the Arms Act has prayed for grant of anticipatory bail. It was submitted by learned counsel for the petitioner that land dispute in between the parties was going on and there is case and counter case. In the case which has been lodged by the mother of the petitioner it has been alleged that informant's side had arrived at her residence and forcibly had snatched double barrel gun and while alarm was raised they left the place after leaving their motorcycle. The said motorcycle has been seized in
Patna High Court Cr.Misc. No.19670 of 2016 (2) dt.20-05-2016 2/2 Barauli P.S. Case No. 04 of 2016.
Besides hearing , I have also perused the material available on record including the order of the learned Sessions Judge which indicates that dispute in between the parties was going on and one motorcycle as alleged by the mother of the petitioner was seized in Barauli P.S. Case No. 04 of 2016. In view of the facts and circumstances in the event of arrest or surrender within a period of six weeks from today let the petitioner Abhishek alias Soni alias Abhishek Kumar Singh be released on bail on furnishing bail bond of Rs. 10000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gopalganj in connection with Barauli P.S. Case No. 03 of 2016 subject to conditions as contemplated under section 438(2) of the Cr.P.C. (Rakesh Kumar, J) Praful/- U T
