Mr. Sujeet Kumar Sinha, learned counsel appearing on behalf of the petitioner at the outset submitted that in view of order dated 03.12.2024 passed in the present writ petition, the Oath Commissioner has filed a show cause giving information that the mistake committed was not intentional and also in no manner to mislead the Court. He further submitted

Patna High Court CWJC No.8268 of 2021(8) dt.09-01-2025 2/2 that he will be more conscious in future and will be meticulously verifying the different paragraph of any affidavit on the basis of pleadings made in respect of what has been pleaded by way of knowledge, information and by way of submission in accordance with the procedure prescribed in Patna High Court Rules, as well as, Code of Civil Procedure.

3. Having perused the statement contained in I.A. No.1 of 2024 and the information contained therein, I find that sufficient reason has been assigned. The show cause is accepted.

4. I.A No. 1 of 2024 stands disposed of.

Re: CWJC No.8268 of 2021:

5. At this stage, learned counsel appearing on behalf of the petitioner upon instruction seeks to withdraw the present writ petition with a liberty to file a fresh writ petition.

6. The writ petition is dismissed as withdrawn with the aforesaid liberty.
