This is an application for bail in connection with Excise Case No. 388 of 2017 registered for the offences punishable under Section 30(a) of Bihar Prohibition and Excise Act, 2016. Allegation against the petitioner is of recovery of six litres of Mahua liquor from his possession.

Submission of learned counsel for the petitioner is that he has falsely been implicated in this case and nothing has been recovered from his possession and he is in custody since 23.7.2017 having no criminal antecedent.

Having heard both sides and in the facts and circumstances of the case, let the petitioner, above named, be

Patna High Court Cr.Misc. No.44665 of 2017 (3) dt.10-10-2017 2/2 released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge-II-cum-Special Court, Excise, Rohtas at Sasaram, in connection with Excise Case No. 388 of 2017, subject to the following conditions :- (1) One of the bailors shall be a local person having sufficient immoveable properties in the jurisdiction of court concerned, (2) Petitioner shall co-operate in trial and appear on each and every date fixed in court and failure to appear on two consecutive dates without any genuine reason or without permission of court, his bail bond shall be liable to be cancelled.
