JUSTICE ANIL KUMAR SINHA ORAL ORDER 17-07-2019 The petitioner apprehends his arrest in connection with Complaint Case NO. 489C of 2017 registered under Section 498A of the Indian Penal Code and 3 and 4 of the Dowry Prohibition Act.

Allegation against the petitioner is that marriage of the petitioner was solemnised with the complainant in the year 2010. It has further been alleged that after some time, the petitioner and his family members started demanding Rs. One lac and a motorcycle from the family members of the complainant as dowry and due to non-fulfillment of the same, petitioner started to assault the complainant by fist and slaps and other accused persons also used to torture the complainant.

No.15846 of 2019(5) dt.17-07-2019 2/3 The matter was referred for mediation by this Court and mediation report dated 28.06.2019 is at Flag-M, shows that process of mediation has failed. However, by order dated 08.07.2019, this Court, in order to take last efforts for amicable settlement between the parties, had directed both, petitioner and O.P.No. 2, to be present personally in Chambers at 4:00 P.M. along with their respective counsels. Learned counsel for the petitioner and learned counsel for the O.P. No. 2 are present. Petitioner Pappu Kumar Tanti is present but O.P. No. 2 is not present. Learned counsel for the O.P.No. 2 informs that O.P.No. 2 is not willing to come for settlement.

In view of the aforesaid circumstances and taking into consideration the fact that O.P.No. 2 did not appear before this Court for amicable settlement between the parties and further the allegation appears to be general and omnibus in nature, accordingly, I am inclined to grant anticipatory bail to the petitioner. Let the petitioner, abovenamed, in the event of arrest or surrender before the court below within a period of four weeks from the date of receipt of a copy of this order, be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned CJM, Jamui in connection with Complaint Case No.
