The petitioner seeks regular bail in Dev P.S.Case No.13 of 2017 registered for the offence under Section 366(A) of the I.P.C.

Allegation against the petitioner is of kidnapping the daughter of the informant and committing gang rape upon her. Submission of the learned counsel for the petitioner is that there are two different versions of the victim girl and her mother. It is a case of love affairs and he has falsely been implicated in this case. He is in custody since 16.05.2017 having no criminal antecedent.

Heard learned A.P.P. also who apposed the prayer for bail on the ground that it is a case of kidnapping and gang rape.

No.44896 of 2017 (4) dt.06-11-2017 2/2 Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant bail to the petitioner. However, the trial court is directed to expedite the trial. The petitioner is at liberty to renew his prayer for bail, if substantive progress is made in the trial.
