In this case, the petitioner is seeking anticipatory bail in connection with Budha Colony P.S. Case No. 350 of 2018, G.R. No.6205 of 2018, registered for the offence under Section 366A of the Indian Penal Code.
Allegation has been made against the petitioner to have kidnapped the daughter of the informant for the purposes of marriage.
Learned counsel for the petitioner has drawn the attention of this Court to the affidavit sworn by the petitioner as well the daughter of the informant, namely, Kajal, who is alleged to have been kidnapped, wherein it has been averred that
Patna High Court CR. MISC. No.20052 of 2019(2) dt.02-04-2019 2/2 they have entered into the marriage voluntarily without any dowry and they want to leave peacefully.
Looking to the aforesaid fact, let the above-named petitioner be released on anticipatory bail in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties of the like amount each to the satisfaction of the Sub-Judge-XVI -cum- A.C.J.M., Patna, in connection with Budha Colony P.S. Case No.350 of 2018, G.R. No.6205 of 2018, subject to the condition as laid down under Section 438(2) of the Code of Criminal Procedure.
