The petitioner has filed this petition for modification of order dated 09.10.2015 passed in Cr.Misc.No.24378 of 2015 and prayed to extend the period for depositing the amount of 20% of Rs.89,25,666.61/-. The petitioner was granted anticipatory bail vide order dated 09.10.2015 on his undertaking that he would deposit 20% of Rs.89,25,666.61/- in the account of BSFC within six months from the date of the order.

Pursuant to the order aforesaid, the petitioner surrendered in the court below and he was granted bail but it appears that the petitioner did not deposit 20% of Rs. 89,25,666.61/- as he had undertaken to deposit the same within six months from the date of

Patna High Court Cr.Misc. No.20254 of 2016 (2) dt.07-09-2016 2/2 the order, i.e., on 09.10.2015. The explanation given for nondepositing of the amount is unsatisfactory and not worth reliable. Considering the fact that the petitioner has intentionally and knowingly broken his words, I am not inclined to extend the period for depositing the amount.

Accordingly, the modification petition is dismissed.
