The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 341, 307 and 504 of the Indian Penal Code.

The prosecution case is that the petitioner started abusing the informant. On protest being made he brought a sword from his house and assaulted on the right hand, head, back and other parts of the body of the informant as a result informant fell down when the sister-in-law (Bhabhi) came to rescue she was also assaulted.

It is submitted by learned counsel for the petitioner that the injury of the sister-in-law of the informant has

No.23481 of 2016 (2) dt.25-05-2016 2/2 been found simple in nature and one of the injury of the informant has been found to be grievous, but for the occurrence of 16.01.2016 at 8.00 P.M. the informant and his sister-in-law were examined on 17.01.2016 at 9.00 P.M. and 9.15 P.M. respectively and the age of injury has been found within six hours.

A statement has been made in paragraph 3 of the petition that the petitioners have no criminal antecedent. Considering the nature of accusation, let the learned court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders before the learned court below within a period of six weeks from today in connection with Laxmipur P.S. Case No. 12 of 2016 pending in the court of learned Judicial Magistrate, Ist Class, Jamui. Accordingly, this application is disposed of. (Dinesh Kumar Singh, J) DKS/- U T
