Petitioner seeks bail in a case registered for the offences punishable under Section 414 of the Indian Penal Code. Petitioner is in jail custody since 13.04.2018. According to the F.I.R., the allegation against the petitioner is that one stolen motorcycle was recovered from the conscious possession of the petitioner.

Submission on behalf of the petitioner is that the first information report goes to show that when the petitioner was caught with motorcycle, he disclosed that one Rahul had handed over the aforesaid motorcycle to him. And moreover, petitioner

Patna High Court Cr.Misc. No.43739 of 2018 (2) dt.23-07-2018 2/2 does not have any criminal antecedent which is evident from perusal of para 3 of the petition.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-XIV, Patna in connection with Gardanibagh P.S. Case No. 148 of 2018.
