JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 09-08-2017 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The trial of the petitioner has already commenced as it is evident from perusal of the impunged order itself. It is a serious case of not only gang rape but the case has also been registered under POCSO Act and, therefore, considering the aforesaid fact, again, I am not inclined to release the petitioner on bail, hence, his prayer for bail in connection with Aurangabad Mahila P.S. Case No. 13 of 2016 ( G.R.No. 16/16), pending in the court of learned Additional Sessions Judge 1st cum Special Judge ( POCSO) Act, Aurangabad stands rejected.

However, the trail court should expedite the trail of

Patna High Court Cr.Misc. No.35733 of 2017 (2) dt.09-08-2017 2/2 the petitioner as the petitioner is in jail custody for more than one year and try to conclude the same as early as possible, preferably, within four months from the date of receipt/ production of a copy of this order.
