The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 376/511 and 509 of the Indian Penal Code.

The prosecution case is that the petitioner made an attempt to ravish the informant.

It is submitted by learned counsel for the petitioner that the petitioner claims to have performed marriage with the informant and has filed Matrimonial Suit No. 311 of 2014 for restitution of conjugal rights, but the informant is not appearing in the matrimonial suit.

No.24440 of 2015 (3) dt.15-10-2015 2/2 It is submitted by learned counsel for the informant that the marriage between the petitioner and the informant has never been performed. The petitioner was on visiting terms with the father of the informant and her photograph and other articles for getting her marriage fixed were taken by the petitioner but the petitioner one day made at attempt to ravish the informant.

Considering the rival submissions of the parties and the nature of dispute, let the learned court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders before the learned court below within a period of six weeks from today in connection with Karja P.S. Case No. 27 of 2015 pending in the court of learned Judicial Magistrate, Ist Class, Muzaffarpur.

With the aforesaid observation, this application is disposed of.
