19-08-2017 Heard Sri Anirudh Kumar Sinha, learned counsel for the petitioner and learned Addl. Public Prosecutor. The sole petitioner, who is in custody since 26-07-2017 in Musarigharari P.S. Case No. 66 of 2017 (G.R. No. 2000/17) registered for offence under Sections 272/273 of the Indian Penal Code and sections 38, 47, 30(a)/38(1)/38(2) and 41(2)(1) of Bihar Prohibition and Excise Act, 2016, has prayed for grant of bail.

It was submitted by learned counsel for the petitioner that nothing was recovered either from conscious possession of the petitioner or from premises of the petitioner, rather in a case, raid was conducted in the house of one Md. Lal Babu and huge quantity of Indian make foreign liquor was seized. The petitioner was made accused on the basis of statement of co-accused Md. Lal

Patna High Court Cr.Misc. No.39710 of 2017 (2) dt.19-08-2017 2/2 Babu. Learned counsel for the petitioner has referred to statement made in paragraph - 3 of the petition to show that petitioner is having clean antecedent.

Considering the nature of accusation, clean antecedent as well as period of custody, let the petitioner namely Rajesh Rai be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.D.J. 6th cum Special Judge, Excise, Samastipur in connection with Musarighari P.S. Case No. 66 of 2017 (G.R. No. 2000/2017).
