19-08-2017 Heard Sri Dheeraj Kumar, learned counsel for the petitioner and learned Addl. Public Prosecutor. The sole petitioner, who is in custody since 08-06-2017 in Chowk P.S. Case No. 149 of 2017 and Special Case No. 2580 of 2017 registered for offence under Sections 30(a), 38/41 of Bihar Prohibition and Excise Act, 2016 and Sections 272/273/34 of the Indian Penal Code, has prayed for grant of bail. Learned counsel for the petitioner, by way of referring to statement made in paragraph - 3 of the petition, submits that petitioner is having clean antecedent. He further submits that nothing was recovered either from conscious possession of the petitioner or from premises of the petitioner, rather in the case, recovery of about 100 litres of Indian make foreign liquor was given effect from the co-accused Sunil Kumar Prasad. The
Patna High Court Cr.Misc. No.39655 of 2017 (2) dt.19-08-2017 2/2 petitioner, on confessional statement of co-accused, has been made accused.
Considering the nature of accusation, clean antecedent as well as period of custody, let the petitioner namely Bachcha Ray be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional District and Sessions Judge (Special Judge, Excise), Patna in connection with Chowk P.S.
