This application is for grant of regular bail in connection with Malaypur P.S.Case No.33 of 2017 , registered for the offences punishable under Section 30(a) of Bihar Excise Act, 2016.

Allegation against the petitioner is of recovery of 107 ltrs. of foreign liquor from his possession and it further appears from perusal of the petition it appears that he is accused in two other cases also and both the cases are of the year, 2016. Submission of the learned counsel for the petitioner is that the petitioner has not been arrested on the spot rather he has been arrested from his house and he has been made accused in this case. So far criminal antecedent of the petitioner is concerned, he

Patna High Court Cr.Misc. No.35189 of 2017 (3) dt.30-08-2017 2/2 has been granted anticipatory bail. It has also been submitted that he is in custody since 18.7.2017.

Heard learned A.P.P. also.

Having heard both sides and in view of recovery as well as having no criminal antecedent, I am not inclined to grant bail to the petitioner, however, the learned trial court is directed to expedite the trial and try to conclude it within a period of four months and if not concluded, the petitioner is at liberty to renew his prayer for bail before the court concerned. With the aforesaid observation, this application is disposed of.
