JUSTICE VINOD KUMAR SINHA ORAL ORDER 06-11-2017 Heard the parties. This application is for grant of regular bail in connection with L.N.M.U.P.S.Case No.109 of 2017 for the offence under Sections 366, 366A of the Indian Penal Code.

Allegation against the petitioner is of kidnapping of minor girl of the informant and forcibly married with her.

Submission of the learned counsel for the petitioner is that the F.I.R. and the statement of the victim

Patna High Court Cr.Misc. No.45011 of 2017 (3) dt.06-11-2017 2/2 girl made under Section 164 Cr.P.C. shows that there is love affairs between the parties. He has not been named in the F.I.R. Later on he had been made accused and he is in custody since 18.05.2017.

Heard learned A.P.P. also who opposed the prayer for bail.

Having heard both sides and in view of the facts and circumstances, as stated above, this application is disposed of with direction to the learned trial court that if charge is framed, he shall release the petitioner to his own satisfaction.

With the aforesaid observation, this application is disposed of.
