JUSTICE MOHIT KUMAR SHAH ORAL ORDER 16-09-2022 The present writ petition has been filed seeking the following reliefs:- "(i) For issuance of an appropriate order/orders, direction/directions to remove encroachment that has been illegally constructed on the land of Canal of Talkhapur bearing Khata No. 597, Khesra No. 97, Mauza-Talkhapur that is covered under Water Resources Division, No. 1, Sitamarhi, that caused the blocked of road.

(ii) For direction the respondents to remove encroachment of Pucca Construction of Bihar Govt. land that has been constructed without the

Patna High Court CWJC No.7990 of 2021(2) dt.16-09-2022 2/2 permission of Government authority."

At the outset, the learned counsel for the petitioner seeks liberty on behalf of the petitioner to approach the Circle Officer, Dumera, District-Sitamarhi, for redressal of his aforesaid grievance.

Liberty so sought is granted.

It is needless to state that in case the petitioner approaches the Circle Officer, Dumera, District-Sitamarhi, by filing appropriate petition under the provisions of the Bihar Public Land Encroachment Act, 1956, within a period of four weeks from today, the same shall be considered, in accordance with law and after hearing the affected parties, appropriate orders shall be passed thereon, forthwith.

The writ petition stands disposed off on the aforesaid terms.
