This application is for grant of regular bail in connection with Ara Rail P.S.Case No.41 of 2017 , registered for the offences punishable under Section 392 of the Indian Penal Code and added Sections 411 and 414 of the Indian Penal Code. The petitioner is not named in the FIR and later on his name transpired as well one mobile phone was recovered from his possession. It further appears from the impugned order that he has been identified by the informant in the TIP. Submission of the learned counsel for the petitioner is that the petitioner has been falsely implicated in this case and he has no criminal antecedent. Further he is in custody for about 2 1⁄2 months.
Patna High Court Cr.Misc. No.42392 of 2017 (2) dt.13-09-2017 2/2 Heard learned A.P.P. also, who has opposed the prayer for bail.
Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant bail to the petitioner, however, the learned trial court is directed to expedite the trial and try to conclude it within a period of six months and if not concluded, the learned trial court shall release the petitioner in connection with Ara Rail P.S.Case No.41 of 2017 to his own satisfaction.
With the aforesaid observation, this application is dismissed.
