This application for anticipatory bail arises out of Naubatpur P.S. Case No. 596 of 2018, disclosing the offence under Sections 147, 148, 149, 341, 302, 120B of the Indian Penal Code and Section 27 of the Arms Act.

Considering the facts that informant claims to be eye witness of the occurrence and in the case diary there is no material that the allegation against the petitioner is not correct, in the light of the Supreme Court decision, in case of Jai Prakash Singh Vrs. State of Bihar and Others, reported in (2012) 4 SCC 379, I am not inclined to grant privilege of anticipatory bail to the petitioner. The application is, accordingly, rejected.

Th petitioner is directed to appear before the court below within four weeks from today and seek regular bail if so advised. If he does so, his application for regular bail shall be considered on its
