The petitioner has preferred this application for grant of regular bail in connection with Ramgarh P.S.Case no.368 of 2022 registered under sections 307, 341, 323, 504, 279, 506, 324, 354 and 34 of the Indian Penal Code.

As per the prosecution case, the accused persons including petitioner herein are said to have assaulted the informant, his father and the members of his family resulting in grievous injury to the informant's father.

Learned counsel for the petitioner submits that so far as the assault on the informant's father is concerned, the same is specific on coaccused Bharat Pasi and not the petitioner herein. Three other accused persons including the petitioner are said to have assaulted the wife and brother of the informant. The

Patna High Court CR. MISC. No.18081 of 2023(2) dt.16-05-2023 2/2 allegations are general and omnibus in nature. The petitioner is in custody since 20.1.2023 and has no criminal antecedent. Heard learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the allegation of assault with the knife on the father of the informant being specifically on coaccused Bharat Pasi and the allegation against the petitioner and others are general and omnibus in nature, the petitioner having remained in custody for about 4 months since 20.1.2023, his not having any criminal antecedent and chargesheet having been submitted in the case, the Court directs the petitioner to be enlarged on bail in connection with Ramgarh P.S. Case no. 368 of 2022 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Sub-Divisional Court Mohania, Kaimur at Bhabua.
