1. Heard learned counsel for the petitioner, learned A.P.P. for the State and the learned counsel appearing on behalf of the informant.
2. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 366, 376, 506 and 34 of the Indian Penal Code read with Section 67 of the Information and Technology Act.

Learned counsel for the petitioner submits that petitioner is a person with clean antecedent and the informant alleges that petitioner along with Shyam kidnapped her daughter on 16.08.2023 and took her to his house and raped her for four days on false promise of marriage, further on 20.08.2023, the

No.17353 of 2026(2) dt.18-04-2026 2/3 petitioner refused to marry the victim and brought her at Jagdishpur crossing and snatched her mobile and from the mobile of the victim called the informant and informed her that her daughter is at Jagdishpur, accordingly, the informant went to the place of occurrence and brought her back, further the marriage of his daughter was fixed, but petitioner started sending obscene messages and videos to people of the village, as such, her daughter's marriage was called off and petitioner also threatened.

Learned counsel for the petitioner submits that petitioner has been falsely implicated in the instant case by the informant, it is next submitted that petitioner and the victim were in love and they intended to get married, but then the relationship was being objected by the informant. It is further submitted that victim eloped with the petitioner and they performed their marriage, but then since informant was objecting the relationship, as such, the instant false case came to be instituted. It is also submitted that petitioner and the victim are leading a peaceful conjugal life and out of the wedlock, a child was born. It is also submitted that victim is a major and the relationship in between the petitioner and the informant has also normalized after birth of the child.

5. Learned counsel appearing on behalf of the informant submits that he has instructions not to oppose the anticipatory bail application of the petitioner.
6. Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Majhauliya P.S. Case No. 1086 of 2023 subject to the conditions as laid down under Section 482 (2) of BNSS.
7. Accordingly, the instant anticipatory bail application stands allowed.
