JUSTICE AMARESH KUMAR LAL ORAL ORDER 21-01-2015 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in a case registered for the offence punishable under Sections 363, 366(A)/34 IPC. It is submitted that there is no medical report regarding the age as well as rape committed by the petitioner and the victim has herself reached Jandaha police station and she has not been recovered by the police.
It appears from the FIR that the date of occurrence is 12.5.2013, whereas, complaint case was filed on 25.5.2013. It further appears from the order passed by the learned Sessions Judge that the statement of victim has been made under Section 164 Cr.P.C. and she has supported the allegation. Considering the facts and circumstances, in my opinion,
Patna High Court Cr.Misc. No.32234 of 2014 (2) dt.21-01-2015 2/2 the petitioner does not deserve anticipatory bail. His prayer is rejected.
