2. Earlier regular bail petition of the petitioner was rejected by this Court vide order dated 28.08.2024 in Cr. Misc. No. 10687 of 2023, but the petitioner is renewing his prayer for bail on the ground that the case of the petitioner is on similar footing to that of co-accused Santosh Kumar, who has been granted bail by a co-ordinate Bench of this Court in Cr. Misc. No. 87507 of 2024. The blood-stained clothes were recovered from the house of co-accused Santosh Kumar. The petitioner is under custody since 03.06.2022
3. The report in respect of the stage of trial has been called for and received, which shows that among the four chargesheeted witnesses, only one has been examined, whereas
Patna High Court CR. MISC. No.19446 of 2025(5) dt.19-09-2025 2/2 the charges were framed on 14.03.2023. All the processes, including non-bailable warrants, have been issued to procure the attendance of the witnesses, but they did not appear before the Court to render their depositions.

Considering the above-mentioned facts and circumstances, let the petitioner above-named be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned ADJ-1, Patna City in connection with Didarganj P.S. Case No. 141 of 2022, subject to the following condition that the petitioner shall cooperate in the disposal of trial and make himself available on each and every date till conclusion of the trial.
5. The petitioner will appear on each and every date fixed by the court and if he fails to do so on two consecutive dates, unless he is prevented by extremely adverse circumstances, the learned court below will be at liberty to cancel the bail bond of the petitioner.
