The petitioner, already in custody, seeks bail in connection with Ashok Paper Mill P.S.Case No. 134 of 2017 registered under Sections 399 and 402 of the Indian penal Code. And 25(1-b)a/26/35 of the Arms Act.

Allegation in brief is that on secret information about assembling of criminals' gang planning for committing dacoity, the police raided the place and apprehended several persons and they were found in possession of loaded arms and from possession of the petitioner also one country made pistol with live cartridge and magazine were recovered.

Learned counsel for the petitioner submits that petitioner has been in custody in this case since 12.12.2017 and only charge sheet has been submitted.

No.36357 of 2018(2) dt.28-06-2018 2/2 However, besides recovery of arms from the possession of the petitioner, he has four criminal antecedents including the present case of Arms Act, so presently prayer of bail of the petitioner is rejected. He may renew his prayer of bail after six months of the framing of charge.
