2. The petitioner seeks bail in connection with Chanan P.S.Case No. 46 of 2023 registered for the offence punishable under Sections 341, 342, 323, 307, 384, 386/34 of the Indian Penal Code and Section 25 (1-b) a, 26, 27 of the Arms Act.
3. The petitioner is accused of demanding extortion . From reading of the FIR, it appears that it is a dispute or sand mining.
4. Learned counsel for the petitioner submits that petitioner is in custody since 08.12.2023, having clean antecedent.
5. Considering the facts and circumstance of the case,
Patna High Court CR. MISC. No.23062 of 2024( 2 ) dt.04-04-2024 2/2 this application is allowed, let the above named, petitioner is directed to released after framing of charge of Chanan police station case on bail on furnishing bail bonds of Rs. 10,000/- ( ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Lakhisarai in Chanan P.S.Case No. 46 of 2023.
6. This is also subject to the conditions that the petitioner shall mark his attendance in Chanan Police Station on first Sunday of every month and co-operate in the trial. If he fails to do so, the bail bonds of the petitioner shall be cancelled. (Sandeep Kumar, J) N.K/- U T
