====================================================== CORAM: HONOURABLE MR. JUSTICE ARVIND SINGH CHANDEL ORAL ORDER 09-04-2025 This petition has been preferred by the petitioner seeking following reliefs:

i. For issuance of writ of mandamus directing the respondent BSFC to make payment of dues to the petitioner contained in Letter No. 712 dated 25.03.2017 (Annexure P/2) with 18% simple interest since it was issued to the date of receiving to the petitioner;

ii. For issuance of writ of mandamus directing the respondent BSFC to make payment of part salary to the petitioner and arrears thereof for the period of 31.01.2014 to 18.03.2016 as per calculation contained in application dated 01.06.2020 and Memo No. Stha-341-B-1457 dated 26.02.2014, Letter Nos. 341-B-38 dated 11.04.2014 & 89-

Patna High Court CWJC No.5625 of 2025(2) dt.09-04-2025 2/3 M-737 dated 17.07.2017 (Annexure P/6 Series), application dated 18.08.2021 along with LPC and Monthly Salary Certificate (MSC) contained in Memo Nos. B-1579 dated 12.03.2014 & 83/M-590 dated 18.08.2021 respectively (Annexure P/7 Series) and photo copy of application dated 26.08.2023 (Annexure P/8) along with 18% simple interest since same is due to date of receiving of to the petitioner; iii. For issuance of appropriate writ/s directing the respondents to pay a suitable cost for its negligence and non-performance;

iv. Any other relief/reliefs for which petitioner is entitled under law.

It is submitted by the counsel for the petitioner that petitioner was appointed on regular basis at the post of Assistant Godown Manager in BISCOUMAN, Patna in the year 1981, subsequently, in the year of 2014 he was sent on deputation to BSFC on the post of Assistant Godown Manager in Danapur Godown under the Office of District Manager, BSFC, Patna for the period of 22.01.2014 to 17.07.2016 and in the year 2016, he was sent back to his original posting at BISCOMAUN, Patna from where he retired on 31.03.2021. According to the counsel, during his deputation period petitioner has to be paid Rs. 34,25,896/- from BSFC out of which BSFC made payment of only Rs. 26,00,000/-. He further submitted that the petitioner is also entitled to get benefit of salary which he was granted by the BISCOMAUN, Patna which has not been paid by

Counsel for the respondent-BSFC, Shri Shailendra Kumar Singh, Adv., submits that the petitioner may be directed to file a detailed representation before the concerned respondent no. 02 along with the relevant documents and on submission of such the concerned respondent no. 2 will decide the same as per the direction given by this Court.

Considering the submission made by the counsel for the respondent, this writ petition is disposed of, petitioner is directed to file a detailed representation raising all grounds which he raised in this writ application along with the supporting documents before respondent no. 02 within 30 days from today and in turn, the respondent no. 02 is also directed to consider and decide the representation made by the petitioner in accordance with relevant rules and laws as early as possible probably within 90 days from the submission of such representation and pass a reasoned order.

5. With the aforesaid observation, this writ petition is disposed of.
